PRIVACY POLICY This Privacy Policy was last updated on: May 18th, 2020 In this Privacy Policy, references to "we" or "us" are references to Field Tools. This Privacy Policy both applies to use of the fieldtools.com website (the "Site") and to the Field Tools software and applications made available through the Site, including applications for use on mobile devices (collectively, the "Software"). Your privacy is very important to us. Part of our operation of this Site and the Software involves the collection and use of information about you. This Privacy Policy explains what type of information we collect and what we do with that information to allow you to make choices about the way your information is collected and used. We are located in the United States, and this Site and the Software are not offered to users in the European Union or in California. ---- SECTION 1 - WHAT INFORMATION DO WE COLLECT? In general, you can visit this Site without identifying who you are or revealing any information about yourself. Information collected online can generally be categorized as anonymous or personally identifiable. "Anonymous Information" is information that cannot be connected to the identity of a specific individual. Personally identifiable information ("Personal Information") is information that specifically identifies a particular user, such as name, address, or phone number. An example of Anonymous Information is the fact that, while this Site may record the number of visits to a particular page that occur in a given period of time, it does not necessarily tell us the names or other identifying information of every visitor. If and when you download and/or use the Software, you may be asked for your additional information, as set forth in further detail below. In order to us to provide the products, services or content requested through the Site or via the Software, we need this Personal Information. Therefore, if you do not provide such Personal Information, we cannot deliver the products, services, or content. We collect data in the following ways: Data Collected Automatically. When you use the Site, we automatically collect non-personal data, such as device identifiers such as IP addresses, location information and user activity. "Cookies". When you use the Site, we may store some data on your computer in the form of a "cookie" to automatically recognize your device the next time you visit. Cookies are small data files, typically made up of a string of text and numbers, that assign you a unique identifier. When you contact us, complete forms via our Site, complete forms via the Software, or respond to surveys, questionnaires or applications we make available, or if you email us, you are voluntarily releasing information to us. When you use the Software, we will ask that you provide Personal Information such as your contact information and if you use the health screening Software, you will be asked health screening questions and other questions relating to facility specific employment requirements via the Software, and will further ask that you provide Personal Information relating to your health in response (collectively, "User Data"). You may decide not to volunteer information, but this may limit the functionality of the Site and/or the Software. SECTION 2 - WHAT DO WE DO WITH YOUR INFORMATION? Companies use the Software to collect safety information reported by employees and contractors at job sites. Where the Software has been downloaded by a company for use by it's employees and contractors, we will disclose Personal Information collected about those individuals through the Software to that company, including individuals’ first and last name, phone number, email, and the date that the form was submitted through the Software. If a company requests that it's employees and/or contractors provide information such as job names, job numbers, and address information through the Software, that information will also be shared with the company. If a company is using the health screening Software, the results of the health screening test (pass or fail) taken by the company’s employees and/or contractors will be shared with the company. The following information is also stored locally on users’ devices on which the Software is installed to help auto populate fields on certain forms: first name, last name, phone, email, and company name. We use information we collect about Site visitors to help us operate the Site, to provide services that you have requested, to complete transactions requested by you, to respond to your inquiries, and for our own marketing purposes. We may also use the information to provide you with certain communication, such as service announcements and administrative messages. We may also monitor and analyze data trends and usage. If you provide your contact information to us, you agree that we may contact you with information regarding our services, including but not limited to newsletters, advertisements and other marketing materials, which may include information regarding our websites or software, new products and other updates. We use Google Analytics and associated tools on the Site to track visitor statistics, to help analyze how the Site is used, and to help us show you advertisements that are relevant to you. Through these tools, we collect information including but not limited to the collection of device-specific information, log information, location information, cookie-related information, and visitor behavior information. The information generated about your use of the Site (including IP address) is transmitted to Google, and this information is then used to evaluate the Site and to compile statistical reports on Site activity, and to provide advertisements in search results, banner ads on third party websites, or in other forms. We use this information to better understand use of this Site and topics of interest among site visitors. We may also share your Personal Information when we believe in good faith that disclosure is necessary to protect our rights or property, protect your safety or the safety of others, investigate fraud, or respond to a government agency, law enforcement, judicial or public authority, or other legal request, or to comply with the law. We may also share your Personal Information with our lawyers and other professional advisors, and third party providers of services such as cloud storage, customer relationship management systems, and others who need your Personal Information to provide services to us (or on our behalf). Subject to applicable law, and as we deem appropriate, we may also share or disclose your Anonymous Information, public information, and aggregated information that is not reasonably linkable to you or your device with third parties. If our websites or software are acquired or merged with another company, your Personal Information may be transferred to the new owners so that we may continue to provide services to you. Once you leave our websites or software or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our websites or software Terms of Service. We do not control the collection or use of your information by these companies, and our Privacy Policy does not extend to external websites or companies. SECTION 5 - SECURITY To protect your Personal Information, we take reasonable precautions and follow industry standard practices to protect Personal Information so that it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. We do not, however, guarantee that unauthorized, inadvertent disclosure will never occur, as we cannot fully eliminate security risks associated with data breaches due to system failures, unauthorized access by third parties, or mistakes. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL). Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.
